In these Terms, references to "Matex Net Member" shall mean the end user accessing the Website services, its contents or using the Services offered.
1. Scope: You understand and acknowledge that Matex Net acts as an "Intermediary" as defined under clause (1) sub-clause (w) of Section 2 of the Information Technology Act, 2000.
Matex Net acts as a platform to enable any user to register themselves on the portal by filling the mandatory fields and optional fields, if any.
2. Registration: a. Registration for becoming a member of the Property Portal (Portal) is free as on date. Matex Net may at any point of time and without notice to can charge for registering in the Portal.
b. If at any point of time Matex Net comes to know or is so informed by third party or has reasons to believe that any information provided by you for registration or otherwise is found to be untrue, inaccurate, or incomplete, Matex Net shall have full right to suspend or terminate (without any notice) your membership and forfeit any amount paid by you towards membership fee and refuse to provide the service to you thereafter.
c. Matex Net also reserves the right to block the registration on Website if any, in the case of your contact details/links being entered in irrelevant fields or if there are errors in any data entered by the MATEX members in their information.
d. Member means an individual who is above 18 years of age or corporate member or the signatory, whose particulars are contained in the application form and includes his successors and permitted assignees. It also includes any person who access the website of the Company.
e. Organizations, companies, businesses and/or individuals carrying on similar or competitive business cannot become Members of Matex Net and or use the Matex Net's Service or Matex Net members data for any commercial purpose.,
Matex Net reserves the right to initiate appropriate legal action for breach of these obligation.
3. Listing of Properties: The information on listing of Properties on the website of Matex Net is for information purposes and may not provide the complete details of the Property. Matex Net does not assume the responsibility as to the encumbrances of the Property, the fitness of purpose of the Property, as to the continued availability of the Property for the members. It is for the members to contact the bank(s) directly to get the full details and the terms and conditions relating to the Property.
4. Photographs of the Property: The Photographs of the Property if any shown on the website are for illustrative purposes only and does not reflect the actual Property.
5. Your Mobile network: You acknowledge that the terms of agreement with your respective mobile network provider (‘Mobile Provider’) will continue to apply when using the website. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the website or any such third-party charges as may arise. You accept responsibility for any such charges that arise.
6. Username & Password: You agree to keep your Username & Password confidential. You shall be responsible for all activities that occur under your Username and Password.
7. Intellectual Property Rights: All trademarks, copyright, database rights and other intellectual property rights of any nature in the website together with the underlying software code are owned directly by Matex Net.
8. Availability: Matex Net will use reasonable efforts to make the website available at all times. However, you acknowledge the website is provided over the internet and mobile networks and so the quality and availability of the website may be affected by factors outside Matex Net's reasonable control. Matex Net reserves the right to add/delete/alter/modify/suspend any or all its services at any time as it may deem fit, without notice.
9. Matex Net does not accept any responsibility whatsoever for unavailability of the website or any difficulty or inability to download or access content or any other communication system failure which may result in the website being unavailable. Matex Net will not be responsible for any support or maintenance for the website.
10. Notwithstanding anything to the contrary contained herein, the Matex Net liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Matex Net for availment of its services
11. Matex Net reserves the right to add/delete/alter/modify/suspend any or all its services or its Terms and Conditions at any time as it may deem fit, without notice.
12. Matex Net is not responsible for non-performance of the services due to force majeure conditions like pandemic, epidemic, earthquakes, flood, explosions, war, drought, riot, lockouts, strikes, acts of terrorism or any other event beyond its control.
13. Restricted/Prohibited action As a MATEX member, you agree to not:
a. Use the website in any unlawful manner or in a manner that promotes or encourages illegal activity including copyright infringement.
b. Attempt to gain unauthorised access to the website or any networking services or computer systems connected to the website.
c. Modify, adapt, translate or reverse engineer any part of the website or reformat or reframe any portion of the pages comprising the website.
d. Use any data mining or extraction methods in relation with the website.
e. Interfere with or hinder the operation of the website or any other individual's use of the website any way.
f. Compromise the security of the website
g. Distribute spam.
14. Collecting of Information By registering as a member, you agree to let Matex Net collect information about your usage of the website. Matex Net may collect your personal information, usage information and information about your device such as the model, manufacturer and OS version of device used, address, time-stamped logs of messages, network status etc.,
15. Indemnification You agree to defend, indemnify and hold Matex Net's directors, officers, agents, employees, consultants, in full and on demand and against any loss, damage, liability, or demand, cost or expenses including reasonable attorney’s fees which they suffer or incur directly or indirectly as a result of your mis- use of the website or otherwise in accordance with the terms or applicable laws. This defence and indemnification obligation will survive in perpetuity
16. Termination. Membership may be terminated by Matex Net / you without assigning any reasons Upon termination, your right to use or access to Matex Net's services will cease immediately. All provisions of this terms and conditions that by their nature should survive termination shall survive termination, including, without limitation, disclaimers, and limitations of liability. Termination of your access to and use of Matex Net's portal shall not relieve you of any obligations arising or accruing prior to such termination.
17. Third Party Links. Matex Net's members understand and agree that Matex Net may allow third parties to put up advertisements on its website, and Matex Net does not control the contents of such third-party advertisement on its website. Third party websites to which links are given on the website are not governed by these Terms and conditions and all such third-party websites/links are governed by their own terms and conditions for use and privacy policy, and in case of conflict the terms and conditions of the third-party website /links shall prevail. Matex Net does not in any manner whatsoever authenticate, endorse, verify or certify these third-party websites/links or any contents therein. Please note that a user shall click on links to third party websites at his / her sole risk and responsibility.

The Grievance Officer shall handle complaints in relation to the following violation by the members of Matex Net in relation to hosting, displaying, uploading, modifying, publishing, transmitting updating or sharing any information that
a. Belongs to another person and to which the Member does not have any right to
b. Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
c. Harm minors in any way
d. Infringes any patent, trademark, copyright or other proprietary rights
e. Violates any law for the time being in force
f. Deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature
g. Impersonate another person.
h. Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.
i. Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting to any nation
